Whether you are an educator in a Louisiana public school district, a Charter School, or a public institution of higher education, we frequently represent members of the Louisiana Association of Educators who are referred to us.
It is crucial for educators to be aware of the following laws concerning their rights. If you suspect that your rights have been violated in any of these areas, please contact our office immediately.
Banning Persons from School Property
Educators have the authority to request that the school district ban a parent from school grounds if they are causing disturbances, using profanity in front of students, or threatening physical harm to you or any student. Parents who disregard school district orders to stay away may face arrest and criminal prosecution.
Child Abuse and Neglect
Educators are mandated to report suspected child abuse or neglect to the appropriate authorities. Failing to make a report can lead to criminal prosecution! Contact Blackwell & Bullman, LLC for guidance on how to report suspicions of abuse and understand your rights and responsibilities as an educator.
Electronic Communication with Students Law
As of November 15, 2009, all school boards are required to adopt policies regarding educators' electronic communication with students, including texting. Ensure you are familiar with your school board's policy, noting that charter schools are exempt.
Grade Changes Law
This law affirms that educators have rights if an administrator, principal, or anyone else attempts to influence or alter a student’s assigned grade.

Reporting Criminal Offenses Law
This law outlines the rights and responsibilities of educators who wish to file criminal charges against a student. Often, school administrators may discourage this, so it’s vital for educational professionals to understand this law.
Safety Crisis Plans Law
This law mandates that all Louisiana school districts create comprehensive safety plans for schools. Educators should be well-versed in their schools’ crisis plans.
Safety Duty Law
This law requires school boards to provide educators with a workplace that is free from recognized dangers or hazards that could cause serious injury or death.
